Gun Rights Restoration Attorney Lynne Torgerson wins victory in Hennepin County

Second Amendment Attorney Lynne Torgerson won restoration of gun rights in the County of Hennepin.  Petitioner brought a Petition to Restore Second Amendment rights. In Minnesota, a person loses their gun rights when they are convicted of a felony crime of violence. A felony crime of violence does not necessarily include violence. For example, a felony drug conviction is considered a felony crime of violence. To gain restoration, a person has to bring a petition in a district court pursuant to Minnesota statute section 609.165. Said Petitioner must also established good cause. Good cause has generally been deemed to be a public safety analysis. There is not set waiting period. Some of the facts included the following: Petitioner is married and has been with his wife 29 years.  Petitioner has coached his childrens’ athletic events.  Petitioner is gainfully employed in the bail bonding field.  Petitioner does not use illegal drugs or alcohol.  The disqualifying offenses were drug crimes.  It has been 15 years since Petitioner’s last criminal conviction.  The Court found that Petitioner does not pose a risk to public safety.  Finding good cause for restoration of rights to possess firearms, the Hennepin County District Court, the Honorable Sarah E. Hudleston presiding, granted Petitioner’s request to restore his Second Amendment rights.  Well done Ms. Torgerson.
